THE NEW YORK SUPERINTENDENT OF INSURANCE accepts process on behalf of many insurance businesses if they are registered and transacting business within the state.  Servico will personally serve the Superintendent of Insurance at your request.

A Service of Process action may be served against any insurance company licensed in New York State (pursuant to Section 1212 of the Insurance Law), an unlicensed insurance company (pursuant to Section 1213 of the Insurance Law), a Federal Risk Retention Group (Section 5904), or a Federal Purchasing Group (Section 5908), for an action taking place in a Court located in New York State.The New York State Insurance Department does not accept Service of Process against Motor Vehicle Accident Indemnity Corporation, the State Insurance Fund, resident agents and brokers, or Health Maintenance Organizations. The court of venue may be in any county located in New York State.

If action is taking place in a court located in New York State and if it is against a licensed insurance company, Risk Retention or Purchasing Group:

The total cost is $80 including the fee to NYS, and we will need 1 copy of the document being served.

If action is taking place in a court located in New York State and it is against an insurance company not licensed in New York State, it will be accepted pursuant to Section 1213 of the Insurance Law:

The total cost is $80, including the fee to NYS, and we will need 2 copies of the document being served.
